AUDIENCE PARTICIPATION
The Performance may include voluntary audience participation. Client agrees that:
1. All audience participation is voluntary
2. Participants assume any risk associated with participation

4. Performer reserves the right to select participants at their sole discretion
Client agrees to indemnify and hold Performer harmless from any claims arising from voluntary audience participation, except in cases of Performer's gross negligence or willful misconduct.

7. CANCELLATION POLICY

Force Majeure: Neither party shall be liable for cancellation due to circumstances beyond reasonable control. Parties will negotiate in good faith for rescheduling or refund.
No-Show by Magician: Full refund of all amounts paid.
No-Show by Client/Venue Closure: Full payment due to Magician.

8. RECORDING & INTELLECTUAL PROPERTY

TRADE SECRET PROTECTION: Client acknowledges that the methods, techniques, and secrets of the magic effects performed are proprietary trade secrets of the Magician. Client agrees not to disclose, explain, or attempt to replicate any magic effects or their methods. This obligation survives termination of this Agreement.

9. LIABILITY

Magician is an independent contractor, not an employee of Client.
Magician is responsible for own props and equipment. Client shall provide a safe performance area.
Client shall maintain adequate liability insurance for the event venue and attendees.
Neither party shall be liable to the other for any indirect, incidental, or consequential damages.

10. GOVERNING LAW

This Agreement shall be governed by the laws of the State of California.
Any disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in the state specified above.
